This seems to be a victory for legal sanity, but everyone needs to consider the Internet to be what it is - A PUBLIC NETWORK - regardless if you put up a notice or even require a login, etc, its a PUBLIC NETWORK (unless adequate authentication AND encryption are used its still a PUBLIC network if its a "website").
