Fed Court: Source Code is First Amendment Protected Speech

A Federal appeals court in Ohio yesterday ruled in the case of Prof. Peter Junger that source code, is first ammendment protected speech. Reminds me alot of RMS's old quote "Free Software is free speech, not free beer."

The ruling comes in the context of a suite brought forth by the Nation Security Agency, who argued that Prof. Junger's class, which discussed encryption techniques, was a national security threat, as his course materials, available electronically, were distributed to foreign nationals enrolled in the school.
