News.com.com.com/com~com is reporting that the Washington DC circuit court has ruled that RIAA campaign to subpoena the identities of Kazaa users in order to sue all the 10 year olds is not legal.
"We are not unsympathetic either to the RIAA’s concern regarding the widespread infringement of its members' copyrights, or to the need for legal tools to protect those rights," the court wrote. "It is not the province of the courts, however, to rewrite (copyright law) in order to make it fit a new and unforeseen Internet architecture, no matter how damaging that development has been to the music industry."
Obviously the judge is more taking the stance against judicial activism and stating that the copyright law is "unfit" and "damaging" rather than rebuking the RIAA's assinie quest as out of the spirit and the letter of copyright, but hey.
